Terms of Service
Effective 5 September 2026
The agreement
These terms are between Stampkaro — a sole proprietorship registered under Udyam, with its place of business in Pithoragarh, Uttarakhand — and the business that creates an account. Creating an account means you accept them. If you are agreeing on behalf of a company, you confirm you are authorised to do so.
What we provide
Software that runs a loyalty program: enrollment QR codes, visit tracking, a reward ladder you configure, a dashboard, staff logins, and WhatsApp notifications to your customers within the limits of your plan.
We provide the software. We do not provide the rewards.
Rewards are your promise, not ours
This is the most important thing in this document, so it is stated plainly.
The free coffee, the discount, the welcome gift — every reward in your program is an offer you make to your customer. Stampkaro records that a reward was earned. We are not a party to it, we do not guarantee it, and we do not honour it.
If a customer disputes a reward, a visit count, the quality of what they received, or anything else about their experience at your premises, that is between you and them. You are responsible for honouring what your program promises, and you agree to indemnify us against any claim brought by your customer arising out of your rewards, your goods or services, or the way your staff operate the program.
We may show a customer what your program says they have earned. That is a record of your program’s configuration, not a promise by us.
Your responsibilities
- Keep your account and staff credentials secure. Anything done through your logins is your responsibility.
- Configure your program honestly, and honour it. Do not advertise a reward you do not intend to give.
- Obtain your customers’ consent before enrolling them, and do not enrol anyone who has not asked to be enrolled.
- Use customer data only to run your loyalty program. Do not export it for marketing unrelated to it, and do not sell it.
- Comply with the law, including data protection and consumer law.
Customer data
Customers are identified by their mobile number, which is a Stampkaro-wide identity rather than something held per business. We determine how that identity works, and you determine what happens in your own program. Each of us is responsible for our own part, and each of us must comply with the Digital Personal Data Protection Act, 2023.
You can see data about visits to your own business only. You can never see a customer’s activity at another business, or that they hold other cards.
Payment
Plans are billed monthly in advance through Razorpay by autopay mandate, at the price shown when you subscribe. Prices exclude taxes, which are added where applicable.
Fees already paid are not refundable, including for a partial month. You can cancel at any time; cancellation stops the next charge and your access continues to the end of the period you have paid for.
If a payment fails we may suspend your dashboard until it is settled. Your data is not deleted while suspended. We may change prices with 30 days’ notice, and you may cancel rather than accept.
WhatsApp messages
Messages are delivered by Meta over the WhatsApp Business Platform and are subject to its rules, pricing and availability. We cannot guarantee delivery, timing, or that Meta will continue to permit any particular kind of message. Message allowances are per plan; beyond your allowance we may send only reward notifications.
Availability
We work to keep Stampkaro running but do not offer a guaranteed uptime level. The service is provided as is, without warranties of any kind to the extent the law allows. Maintenance, outages and dependencies outside our control — hosting, payments, WhatsApp, the internet — can interrupt it.
Keep your own records of anything you cannot afford to lose. We take backups for our own operational purposes and do not offer them as a service to you.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for lost profits, lost revenue, lost goodwill or lost data, however caused.
Our total liability for any and all claims is limited to the fees you paid us in the three months before the claim arose.
Nothing in these terms excludes liability that cannot lawfully be excluded — including under India’s consumer protection and data protection laws, or for fraud. Where a limitation here is found unenforceable, it applies to the maximum extent that is.
Suspension and termination
You can close your account at any time. We may suspend or close an account for non-payment, for breach of these terms, or where use of the service is unlawful or harms customers.
On closure your data and your customers’ cards with you are deleted. Ask before you close if you want an export.
Changes
We may update these terms. Material changes will be notified at least 30 days’ in advance, and continuing to use Stampkaro after they take effect means accepting them.
Governing law
These terms are governed by the laws of India. The courts at Pithoragarh, Uttarakhand have exclusive jurisdiction, except that either party may seek urgent injunctive relief anywhere.
